CSpring Terms of Use, Responsibility, Limitation of Liability & Indemnification

1. Product Use and Scope
CSpring products are designed as accessories intended for use with compatible CPAP equipment. They do not replace, modify, or control the therapeutic functions of any CPAP device. Users are responsible for ensuring compatibility and proper use with their equipment.

2. User Responsibility
By purchasing, installing, or using any CSpring product, you acknowledge and agree that you are solely responsible for:

Proper installation, setup, and operation
Routine monitoring and maintenance
Ensuring all components are clean, secure, and functioning properly
Following all provided instructions, warnings, and guidelines

Failure to follow instructions or maintain equipment may result in improper performance or damage.

3. Assumption of Risk
You acknowledge that the use of accessories involving water, electrical components, and third-party devices carries inherent risks. You voluntarily assume all risks associated with the use, misuse, installation, or operation of CSpring products.

4. No Warranties Beyond Express Terms
To the fullest extent permitted by law, CSpring disclaims all implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose, except where such disclaimers are not permitted by applicable law.

5. Limitation of Liability
CSpring shall not be liable for any damage to CPAP devices, accessories, or other property arising from use, misuse, improper installation, failure to follow instructions, lack of maintenance, modification, or use outside intended conditions.

To the fullest extent permitted by law, CSpring shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

Property damage
Water-related damage
Electrical damage
Loss of use
Loss of profits or business interruption

CSpring shall not be obligated to provide compensation, reimbursement, or replacement for any such damages.

This limitation of liability applies regardless of the legal theory asserted, whether in contract, tort (including negligence), strict liability, or otherwise.

6. Indemnification
You agree to indemnify, defend, and hold harmless CSpring, its owners, officers, employees, affiliates, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use, misuse, or operation of any CSpring product
Improper installation or failure to follow instructions
Use of CSpring products with third-party equipment
Any claim brought by a third party related to your use of the product

7. Limitation Period
Any claim or cause of action arising out of or related to the use of CSpring products must be filed within one (1) year after such claim arises, or it is permanently barred, to the extent permitted by law.

8. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

9. Acceptance of Terms
By purchasing, installing, or using any CSpring product, you acknowledge that you have read, understood, and agree to be bound by these terms.
